In cannabis industry regulatory landscape is changing fast. All stakeholders need to adapt. At Lemur Legal we advise how.
Despite the rapid growth of the cannabis industry, the legal framework governing the development of the cannabis industry is still in its early stages. Because the legislation on cultivation, marketing and regulatory compliance varies greatly across Member States of the European Union, there is still considerable legal uncertainty in the developing field of the cannabis industry. This may also be a result of rapidly changing rules, nonunderstanding of the industry by competent national authorities, as well as new scientific knowledge about the effects of cannabis that also affect the first two factors of uncertainty.
The cannabis related legislation in EU is changing very quickly and unfortunately for the worse. Due to the EU regulation on novel foods, specifically the change in the Catalogue of Novel Foods relating to cannabinoids, the sale of CBD extracts for cosmetic and nutritional purposes is being withdrawn from the market. Companies that sell these products and the farmers who produce them are now required to obtain a marketing and processing authorization from the European Food Safety Authority. The process from filling the application form to obtaining the decision takes an average of 18 months, and the cost of the procedure can amount to more than EUR 250,000.00.
We offer businesses that already operate or want to work in the cannabis industry, as manufacturers or sellers of products, a comprehensive range of legal advisory services that cover a full range of legal issues. Our services include legal support in obtaining the opinions and permits of competent public institutions (in Slovenia a Health Inspectorate is the competent public institution), legal support in inspection procedures, ensuring compliance of business with legal rules and other legal issues specific to this cannabis industry.
